These Website Use Terms (the "Terms") govern your access to and use of the triagents.ai website (the "Website"), operated by TRIAGENTS PTY LTD (ABN 60 698 265 002) ("Triagents", "we", "us").
These Terms do not govern your use of the Triagents platform — that is covered by a separate Customer Agreement signed between us and your clinic group. Where the two documents differ, the Customer Agreement prevails for paying customers in respect of platform use.
02Acceptance
By accessing or using the Website, you accept these Terms. If you do not accept them, do not use the Website. If you are using the Website on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms.
03Permitted use
You may use the Website to:
- Read information about Triagents and its products.
- Request a demonstration or contact us in good faith.
- Download materials we publish for download (e.g. brand assets, whitepapers).
You agree not to:
- Use the Website for any unlawful purpose or in a way that may harm us or any other person.
- Attempt to gain unauthorised access to any part of the Website, server or related system.
- Scrape, harvest or otherwise extract data from the Website at scale without our written consent.
- Reverse engineer, decompile, or attempt to derive the source code of any code served by the Website.
- Misrepresent your identity or affiliation, or impersonate us or any other person.
04No medical advice
Content on this Website is provided for informational purposes only. It is not medical advice. Nothing on the Website should be interpreted as a substitute for professional medical care or as a clinical recommendation. If you are experiencing a medical emergency, call 000 (Australia) or your local emergency number immediately.
05Accounts and access
Some parts of the Website may be gated behind sign-in. If we provide you with credentials, you are responsible for keeping them confidential and for everything that happens under your account. Tell us immediately if you suspect your credentials have been compromised.
06Intellectual property
The Website, including its design, text, code, images, marks and other content, is owned by us or our licensors and is protected by Australian and international intellectual property laws. The Triagents name, logo and the TriageVoice, TriageChat and TriageFlow product marks are our trademarks (whether registered or unregistered).
We grant you a limited, revocable, non-transferable licence to view the Website on a personal device for the permitted uses above. You may quote short extracts of the Website with attribution. All other rights are reserved.
Brand assets we publish for press use are governed by our Brand Guidelines and may not be modified or used in a way that implies endorsement.
07Third-party content
The Website may link to third-party websites or embed third-party content. We do not endorse and are not responsible for the content, accuracy, privacy practices, or security of those sites.
08Your feedback
If you send us feedback, suggestions or ideas (for example, by completing a contact form or sending an email), you grant us a perpetual, worldwide, royalty-free, sub-licensable licence to use that feedback to improve our products and services, without compensation to you.
09Disclaimers
To the maximum extent permitted by law, the Website is provided "as is" and "as available". We do not warrant that the Website will be uninterrupted, error-free, secure, or that information on it is current. Statistics quoted on the Website (for example, pilot results from a specific clinic) reflect a particular customer's experience and are not a promise of the results you will achieve.
Nothing in these Terms excludes consumer guarantees that apply under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
10Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, special, consequential, incidental, exemplary or punitive damages arising out of your use of the Website, even if we have been advised of the possibility of those damages. Our total liability to you in respect of the Website is limited to AUD $100.
Where we cannot lawfully exclude a liability under the Australian Consumer Law, our liability is limited (where the law allows) to: re-supplying the relevant service, or paying the cost of having the service re-supplied.
11Indemnity
You agree to indemnify and hold us harmless against any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Website.
12Suspension and termination
We may suspend or terminate your access to the Website at any time, with or without notice, where we reasonably believe you have breached these Terms or where required by law.
13Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia for any dispute arising out of or in connection with these Terms.
14Changes to these terms
We may update these Terms from time to time. The current version is always available at triagents.ai/terms, with the "Last updated" date at the top. Continued use of the Website after a change indicates acceptance of the updated Terms.
